IMPORTANT - All products and services provided by Rear View Camera Ltd ( or the Company ) are subject to the following terms and conditions and by using this website ( www.rearviewcamera.co.nz ) or requesting any of these products or services you ( the customer ) are subject to the following ' Terms and Conditions ' and by doing so you agree to accept them .
PRIVACY - The customer authorizes Rear View Camera Limited to:
Collect, retain and use personal information about the Customer, including the information contained in this document for the following purposes
- Assessing the customer’s creditworthiness
- Administering the financing, whether directly or indirectly, of the customer’s contract .
- Marketing goods and services provided by Rear View Camera Ltd .
- Provide the information to any person for maintaining effective credit records.
The Customer further acknowledges:
- That the information shall be deemed to be held by Rear View Camera Ltd at the address specified in this document, not withstanding that it may also be held elsewhere by the Rear View Camera Ltd and/or other persons for the purpose described above .
- That where the information can be reality retrieved, the Customer shall have access to it, the right to request correction and the right to be notified.
OWNERSHIP
Ownership and title to the chattels remain with Rear View Camera Ltd until all monies owning by the customer to the Rear View Camera Ltd in respect of the chattels have been paid, not with standing that the chattels may have been given into the customer possession. If required, the customer shall store the chattels in such a way that they be identified as belonging to Rear View Camera Ltd . Until such payment for the chattels is made in full, the customer shall hold the chattels for Rear View Camera Ltd as its bailee and agent, but without the power to raise money on the security of the chattel and Rear View Camera Ltd shall have the right of immediate repossession of the chattels.
PROPERTY / RISK
The Agreement does not cover breakdown due to damage through loss, theft, fire, liquid, flood, accident, power surges or insect infestation unless the Chattel/Credit Protection Insurance has been taken by the Customer. Negligence, Abuse or Financial Loss that may be incurred due to breakdown is not covered at any time. The company or Financer reserves the right to enter premises and recover chattels not paid for in full at any time without notice. The Customer acknowledges that no collateral representations, warranties or undertaking of any nature, whether oral or written, have been or will be given by Rear View Camera Ltd, and that this written agreement represents the entire agreement between the Rear View Camera Ltd and the Customer as to its subject matter.
WARRANTY AND LIMITATION OF LIABILITY
Warranty of Rear View Camera Ltd's products and services is for 12 months ( unless otherwise specified ) from date of GST receipt and states that we will remedy faults or defects in materials , workmanship or design of our products free of charge , at our descretion , by replacing or repairing the defective product . From time to time products and suppliers change if an identical product cannot be supplied , then a similar model with same functions will be provided . Only if no replacement can be provided , will a refund be paid ( shipping not covered ). The warranty is void if product fault is from misuse , modification , abuse or accident and does not cover normal wear and tear. Rear View Camera Ltd reserves the right to make final decision whether claim is from misuse , abuse , accident , modification or failure to maintain OR is a legitimate warranty claim .
Rear View Camera Ltd , it's employee's and agents shall not be liable for breach of contract ( except specified warranty ) or statute or breach of duty in tort ( including negligence ) for any claim in equity or otherwise at law and shall not , in any case , be liable for any exemplary , punitive , indirect ,or consequential losses , including loss of business profits . If the goods or services have been acquired for business purposes the Comsumer Guarrantees Act 1993 does not apply .
SHIPPING AND DELIVERY
It is the customers responibilty to provide the correct delivery and contact details . Rear View Camera Ltd is not liable for deliveries that have been confirmed delivered by the current courier service and have since been lost . Only deliveries lost or damaged in transit will be dealt with by Rear View Camera Ltd .
CHANGES TO TERMS AND CONDITIONS MAY OCCUR OCCASIONALLY AND GO INTO EFFECT FROM DATE OF PUBLISHING .
